جزاء إهمال حامل سند السحب في التشريع الأردني: بين السقوط والتعويض

الأهداف: لقد تناول هذا البحث مشكلة التوفيق بين نص المادة (190) من قانون التجارة الأردني (1966) ونص الفقرة (10) من المادة (183) من ذات القانون. فقد احتوى النص الأول على الحالات التي يسقط فيها حق الحامل المهمل واحتوى النص الثاني على الحالات التي تثور فيها مسؤولية الحامل المهمل بالتعويض. فكل نصِّ من هذين النصين يتناول حالاتٍ محدَّدةً من إهمال الحامل ويفرض جزاءً مختلفاً عن الآخر. ويمكن القول أن هناك تداخلاً بين هذه الحالات يصعب معه تحديد الجزاء الذي يترتب على كلِّ منها.
المنهجية: وإزاء التقاطع الملاحَظ بين الحالات الواردة في هذين النصَّين كان لا بُدَّ من محاولة تحديد نطاق تطبيق كلٍّ منهما باستخدام المنهج التحليلي.
النتائج: وقد توصَّل هذا البحث إلى نتيجة مفادها أن هناك تفرّداً في التشريع الأردني في مقاربته لمسألة إهمال حامل سند السحب، فقد انطوى على تفرقةٍ دقيقةٍ بين حالات الإهمال التي يُعاقَب عليها بالسقوط وحالات الإهمال التي يُعاقب عليها بالتعويض مبتعداً بذلك عن أي تناقضٍ قد توحي به النصوص للوهلة الأولى.
الخلاصة: وقد أوصى البحث بتوحيد الجزاء الذي يطال الحامل المهمل ومالَ إلى قَصْره على جزاء السقوط دون التعويض.
