Investigating Al-Shafi’i’s opinion on reclamation

Abstract

This research aims to show the truth of Al-Shafi’i’s statement regarding reclamation: Many jurists attributed to Al-Shafi’i not to adopt it, perhaps because he denied approval, or because he did not mention reclamation as one of the principles of legislation. This research shows that Al-Shafi’i relied on reformation as a comprehensive principle based on the entirety of Islamic law, and that he based many jurisprudential rulings on it, thus refuting the allegations that were raised about his denial of reformation with evidence.
